Strict liability is an area of the law that makes people responsible for any injury or damage that their actions or products cause. In Pennsylvania strict liability legal cases the person or persons must only prove that the product was defective or that its proper and correct use resulted in the injury, death or damage. Proof of negligence in product liability cases is usually not necessary, though the areas of negligence and strict liability often overlap. In many cases warnings, disclaimers or other notifications regarding a product's safety are still not enough to excuse any damages stemming from the product.
The Pennsylvania Supreme Court recently clarified certain elements of strict liability in that legal action can only be pursued if the product was being used by its intended user, rather than any person at all. The clarification stemmed from a case involving a child who was injured while using a lighter. The Plaintiffs claimed that the lighter was defective because it wasn't child-proof but the Supreme Court ruled that lighters were not intended for children and therefore were exempt from liability in that case.
In the lighter case, the Pennsylvania Supreme Court determined and drew up a new set of guidelines regarding strict liability that encompassed negligence and design properties as well. If a product was not designed in a way that took into account reasonably foreseeable problems then the manufacturer could still be held accountable for any damages or injuries that occurred from its use.
