When a product causes harm to another person there are several types of laws which may be affected. One common law utilized in product liability cases is known as negligence. Negligence cases are often difficult and complex - much more so than strict liability claims or other legal elements. Negligence often implies that the manufacturer actually manufactured the product in a defective way, which is usually difficult to prove, but possible. In some cases of product liability the theory that the manufacturer did not provide adequate warnings on the product itself may fall under the terms of negligence. In Pennsylvania, a case involving product liability negligence must prove certain steps. The first step is to prove what the duty of the manufacturer was in making the product in question. This step is important because it outlines which things the manufacturer would have to legally be aware of as well as which elements of the product build they failed to do. Step two would be a breach of that first duty. This can take place in several different ways including such things as: the manufacturer failed to take obvious safety issues into account when making their product, the manufacturer failed to provide adequate warnings about a product or many others. The third step in a negligence case is the direct relationship between the failure, and breach of duty, by the manufacturer and the injury or death of the person in question. The failure of the manufacturer must have been the direct cause of injury or death. Finally, proof of the injury or death is outlined, as well as all associated costs and problems stemming from the incident. Other types of negligence include "negligence per se" and "res ipsa loquitur." These are both legal terms for a situation where the proof of negligence is very obvious and the case does not need to be outlined in depth usually. An example of this type of product liability negligence would be a car manufacturer who did not conform to auto making standards and because of this their cars were defective inherently and they resulted in injuries or deaths. In these cases the negligence is legally obvious because the manufacturer failed to provide a legally sound product in the first place.
