In a Pennsylvania medical malpractice claim, a plaintiff must establish four key points in order to prove that a healthcare provider (such as a physician, attending nurse, or psychiatrist), was negligent in providing care:

  1. It must be established that the provider owed the plaintiff a duty, legally. An emergency room doctor, for instance, who takes a patient from the OR, assumes a legal duty for that patient's care.

  4. The patient must show that damage has been done. This damage can be monetary (e.g. to repair an injury, other medical procedures had to be performed), physical (e.g., a patient undergoes an unnecessary amputation), or emotional (e.g., a patient and/or his or her family suffers pain, humiliation, or depression).
